Updating the Enabling Legal Environment for the Digital Economy in Palestine

The Palestinian Liberation Organization has received a grant from the International Development Association (IDA) in the amount of USD 20 million for the benefit of the Palestinian Authority (PA) to finance the Digital West Bank & Gaza Project and intends to apply for part of the proceeds for consulting services.

The consulting services (“the Services”) for Updating the Enabling Legal Environment for the Digital Economy in Palestine includes:

  1. Inception report identifies in detail the main activities, methodology, actors, and timelines to carry them out, including the consultation, dissemination and promotion program, and workshops.  The Inception Report will also contain any recommended changes to the ToRs.
  2. Legal Reforms: (a) Gap Analysis (SWOT) detailing field surveys conducted during the consultation phase. (b) Researching and mapping all existing legal studies and analyses and laws and review all these documents in the country as per the above-mentioned scope. (c) Draft report with recommendations on drafts of amendments and new legal instruments, documents, motivated and argued, including draft legislation and regulations. (d) Conduct Public Stakeholder Consultations on proposed drafts, synthesis and motives for final recommendations. (e) The firm should prepare drafts of the proposed legislation for the legal environment related to cybersecurity described above, in addition to amended draft legislation for the legislation in force in the field of cybersecurity, including cybercrime and other legislation mentioned in the scope of this assignment. (f) Final report containing final proposed legal instruments and supporting documents

These services are expected to be finished within a period not exceeding 6 months.

The Ministry of Telecom and Information Technology (MTIT) now invites eligible consulting firms (“Consultants”) to indicate their interest in providing the Services. Interested Consultants should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services.

The shortlisting criteria of the firm are: core business and years in business, relevant experience, technical and managerial capability. Key Experts will not be evaluated at the shortlisting stage.

The attention of interested Consultants is drawn to Section III, paragraphs, 3.14, 3.16, and 3.17 of the World Bank’s “Procurement Regulations for IPF Borrowers” dated November 2020 (“Procurement Regulations”), setting forth the World Bank’s policy on conflict of interest.

Consultants may associate with other firms to enhance their qualifications but should indicate clearly whether the association is in the form of a joint venture and/or a sub-consultancy. In the case of a joint venture, all the partners in the joint venture shall be jointly and severally liable for the entire contract, if selected.

A Consultant will be selected under the Quality and Cost Based Selection (QCBS) procurement method set out in the Procurement Regulations.
